TERMS AND CONDITIONS OF TOURIST RENTAL

These General Terms and Conditions govern the offer and booking of houses, apartments, and luxury villas for tourist use through the website localhouse.kross.travel (hereinafter the “Website”) and are drafted in compliance with the applicable Italian legislation, in particular the Civil Code, Legislative Decree no. 206 of 6 September 2005 (Consumer Code), Legislative Decree no. 70 of 9 April 2003 on electronic commerce, and the regulations concerning tourist rentals.

1. PARTIES TO THE CONTRACT

The tourist rental agreement is entered into between:

LocalHouse srls, with registered office at c.da Piana snc – 98072 Caronia (ME), ITALY, VAT No. 03790440832 (hereinafter “LocalHouse”);
and
The Customer, a natural person who makes a booking through the Website exclusively for tourism-related purposes and not for professional, business, or entrepreneurial purposes.

LocalHouse operates as manager and intermediary in the rental of prestigious tourist properties, either directly or on behalf of the property owners.

2. SUBJECT MATTER OF THE CONTRACT

The subject of this contract is the booking and temporary tourist rental of the property selected by the Customer, for the period indicated during the booking process.

The rental is exclusively for tourism purposes and does not in any way constitute a residential lease relationship pursuant to Italian Law no. 431/1998.

3. PROPERTY CHARACTERISTICS

The features, amenities, capacity, included services, and any specific rules of each property are described in the relevant property listing published on the Website.

Images are for illustrative purposes only. Any slight differences shall not constitute a breach, provided that they do not compromise the quality and standard of the property.

4. PRICES AND ADDITIONAL COSTS

The prices shown on the Website are intended for the entire stay and include what is specified in the property listing.

Unless otherwise indicated, the following may be required:

  • security deposit;
  • final cleaning costs;
  • tourist tax;
  • extra services upon request (private chef, transfer, housekeeping, personalized experiences).

The final price is always summarized before the booking is confirmed.

5. BOOKING PROCEDURE AND CONCLUSION OF THE CONTRACT

The booking is made by completing the online form and paying the required amount.

The contract shall be deemed concluded when the booking is confirmed by LocalHouse via email.

LocalHouse reserves the right to refuse incomplete bookings, bookings that do not comply with the applicable requirements, or bookings that are incompatible with the rules of the property.

6. PAYMENTS

Payments may be made by means of:

  • credit/debit card;
  • PayPal;
  • Apple Pay;
  • Google Pay;
  • other methods indicated on the Website.

In the event of advance payment, access to the property is subject to receipt of the full amount due.

7. SECURITY DEPOSIT

For some properties, a security deposit is required and will be indicated during the booking process.

The deposit is intended to cover any damage to the property, furnishings, or amenities, and will be refunded within the indicated time frame, subject to verification of the condition of the property.

8. CHECK-IN AND CHECK-OUT

Check-in and check-out times are indicated in the property listing.

Any request for early check-in or late check-out is subject to availability and may involve additional charges.

At check-in, a valid identity document may be required for communication to the competent authorities.

9. CUSTOMER OBLIGATIONS

The Customer undertakes to:

  • use the property with due care;
  • respect the maximum occupancy;
  • comply with the house rules and good neighbor conduct;
  • not organize unauthorized parties or events;
  • return the property in the same condition in which it was delivered.

10. LIABILITY

LocalHouse shall not be liable for:

  • theft, loss, or damage to the Customer’s personal belongings;
  • interruptions of services not attributable to its fault;
  • events of force majeure.

11. CANCELLATION POLICY

Cancellation terms vary depending on the property and the selected rate and are clearly indicated before the booking is confirmed.

By making the booking, the Customer declares that they have read and accepted the applicable cancellation policy.

12. WITHDRAWAL

Pursuant to Article 59 of the Italian Consumer Code, the right of withdrawal is excluded for contracts concerning the supply of accommodation for tourist purposes.

13. PRIVACY

Personal data is processed in compliance with Regulation (EU) 2016/679 (GDPR). Full information is available in the Privacy Policy section of the Website.

14. APPLICABLE LAW AND JURISDICTION

This contract is governed by Italian law.

For any dispute, jurisdiction shall lie with the court provided for by the applicable consumer protection legislation.

The European Commission provides an online dispute resolution platform (ODR).
